Governing the relationship between Keety Nannies (Pty) Ltd, independent domestic candidates, and our valued clients.
1. Definitions & Interpretation
"The Agency" refers to Keety Nannies (Pty) Ltd, represented by its owner,
Kate, and authorised staff.
"The Client" refers to any individual or entity engaging The Agency for recruitment
services.
"The Candidate" refers to any nanny, housekeeper, or domestic worker introduced by
The Agency.
These terms are governed by the laws of the Republic of South Africa, including the Basic Conditions of Employment Act (BCEA) and the Consumer Protection Act (CPA).
2. Pricing & Fee Structure
2.1 Registration Fee
A non-refundable registration fee of R450.00 is payable upon commencement of the search. This fee covers administrative costs, vetting procedures, and background checks.
2.2 Placement Fee
Upon successful placement of a Candidate, a once-off placement fee is payable. This fee is calculated based on the Candidate's annual gross salary:
- Permanent Placement (12 Months+): 12% of annual gross salary.
- Temporary Placement (< 3 Months): 20% of total earnings.
- Minimum Placement Fee: R3,500.00 (irrespective of salary percentage).
3. Guarantee & Replacement Policy
The Agency provides a **90-day replacement guarantee**, subject to the following conditions pursuant to the CPA:
- The Placement Fee passed was paid in full within 7 days of the invoice date.
- The termination of employment was not due to unfair labor practices, change in job description, or relocation by The Client.
- The Agency is given 21 days to find a suitable replacement candidate.
- This guarantee allows for **one (1)** replacement candidate free of charge. Further replacements will incur new fees.
4. Legal Liability & Indemnity
Keety Nannies acts solely as a recruitment facilitator. While we perform rigorous criminal checks (SAPS clearance) and reference validation:
The Agency accepts no liability for any loss, damage, theft, or injury sustained by The Client or any third party arising from the employment of The Candidate. The Client remains the legal employer and is responsible for all statutory requirements (UIF, COIDA) and employment contracts.
